We’re making this harder than it should be. Thanks to last year’s referendum, weed is now legal in New Jersey ... sort of. It’s legal to use it and possess it, but it’s illegal to grow it. There’s no place to buy it yet, so assuming you have a hookup, you can store personal use marijuana in your home without fear of arrest and prosecution, just don’t keep it in a flowerpot.
The penalty for growing ONE PLANT of cannabis is 3 to 5 years. Growing 10 or more plants will put you away for 10 to 20. The penalty for possessing one plant’s worth of pot is nothing. The lesson here is if the police knock on your door, yank that sucker out of the planter and chuck it in a jar tout suite.
If you’re thinking, “That makes no damn sense” you’re already quicker on the uptake than the guys who wrote the legislation. As long as you’re below the legal limit it shouldn’t matter what type of receptacle you place your stash in. Thankfully, there’s already a bill in the pipeline to legalize home growing for medical marijuana patients and hopefully, that will be followed quickly by a bill clearing the way for recreational home cultivation. Sen. Vin Gopal (D-Monmouth) has already introduced a bill that would clear up some of these silly oversights and hopefully, stop making this process harder than it should be.
