UPDATE: 10:45 a.m. Wednesday, Sept. 16, 2020 - Council members Morgan and Reynolds and Mayor Schwab voted yes on a complete ban on needle distribution. Council members Stone, Hubert, Ory, and Vice Mayor Brown all voted no on a complete ban.

CHICO, Calif. - Chico City Council failed to pass a motion that would completely ban needle distribution from the city, similar to other cities in Butte County, and for some residents here, a complete ban is what they wanted.

"Mayor Schwab, aye -- motion fails four to three."

Several people lined up outside the council chambers in Chico, and they all shared something similar in mind.

"I'm also going to be commenting on the 5.1 with the needle distribution options," said resident Jesica Giannola who is against needle distribution.

"I'm also here tonight because I really believe needles need to be banned," said Nichole Nava, who is also against needle distribution. "I believe that we have been looking a long time towards that and it's not over yet."

Several cities in Butte County have banned any needle distribution from their city limits, however, one of the cities that hasn't is Chico.

"There is not a complete ban in the city of Chico so that's why some of us are here tonight," said Nava. "We're tired of the needle litter."

In mid-August, the North Valley Harm Reduction Coalition settled with Gallaway Enterprises, Downtown Chico Business Association, and eighteen other plaintiffs to stop needle distribution in Chico.

"We've been fighting the needle distribution program for a while," said Rob Berry, the attorney who filed the lawsuit against NVHRC. "We filed a lawsuit, a lawsuit effectively banning it from the state."

Earlier in the year, he was promised a full presentation, the same as NVHRC.

"[The city council] made a motion to restrict my presentation to three minutes even though they're allowing North Valley to continue for 10 minutes," he said. "I have a timed ten-minute speech to be respectfully for the time I've been given. You cannot restrict that to 3 minutes."

A motion did pass unanimously to allow staff to bring back this motion for cleanup ideas only.

Other cities in Butte County that have completely banned needle distribution include Oroville and Gridley.
